?<xYou should advise the President that he will soon be
receiving the proposed 
Executive Order on Empowerment
Contracting, which he requested during his speec
h on affirmative
action.  Specifically, this Order directs the Secretary of
Com
merce, in consultation with other agencies, to ensure that
agencies provide in 
the Federal procurement process some sort of
?@<incentive (such as price or evaluation preferences, but not setasides) to bu
sinesses that locate in distressed communities or
hire a significant number of 
residents from such communities. 
The Order was drafted to ensure that this pro
gram will encompass
distressed communities involved in other efforts, such as o
ur
Empowerment Zones ("EZ")

Enterprise Communities ("EC") program.  


?<xYou should urge the President to sign the Executive Order. 
The President pr
omised to implement such a program in his
affirmative action speech and many ar
e awaiting the Order.  (You
should inform the President that you have not sough
t his approval
of this Order until this time because the group working on this
issue and certain members of the civil rights community strongly
believed that 
it should not be issued until the Department of
?0<Justice was close to completing its Adarand review, which it is.)

program is in place be
fore Kit Bond's bill  which we believe
would create some sort of placebased pro
curement program similar
to our approach  gains momentum.
