Brett Kavanaugh Attorney Work Files

Brett M. Kavanaugh served as an Associate Independent Counsel in the Office of Independent Counsel Kenneth W. Starr from September 6, 1994 until November 20, 1997 and again from April 27, 1998 until December 1, 1998. Kavanaugh’s attorney work files from his tenure with the Office of Independent Counsel (OIC) consist of eight boxes, numbered 140-145, 366, and 503 in the OIC file manifest for the District of Columbia Office. The files reflect the scope of Kavanaugh’s work on numerous issues within OIC’s purview, particularly the investigation of the death of Deputy White House Counsel Vincent Foster.

Monday, July 30, 2018 -- The National Archives and Records Administration released the first tranche of 19 files, totaling 1,025 pages, from the Attorney Work Files of Brett Kavanaugh in the records of Independent Counsel Kenneth Starr. These files cover various aspects of his work on the Independent Counsel's investigations into the activities of President William Jefferson Clinton and First Lady Hillary Rodham Clinton.

Monday, August 6, 2018 -- NARA has completed its review of an additional 1,063 pages from the Attorney Work Files of Brett Kavanaugh from his service with the Office of Independent Counsel Kenneth W. Starr.  Of these 1,063 pages, 791 pages are being released in full and 272 pages are being released in redacted form.  The information within these 272 pages has been redacted to protect information subject to the following FOIA exemptions: 5 U.S.C. § 552(b)(3), to the secrecy of grand jury proceedings pursuant to Rule 6(e) of the Federal Rules of Criminal Procedure; 5 U.S.C. § 552 (b)(7)(C), to protect the personal privacy of living individuals; and 5 U.S.C. § 552 (b)(4), to protect confidential business information. 

Friday, August 10, 2018 -- NARA has completed its review of an additional 7,626 pages of records of Brett Kavanaugh from his service with the Office of Independent Counsel Kenneth W. Starr.  Of these 7,626 pages, 3,868 pages are being released in full and 3,758 pages are being released in redacted form.  The information within these 3,758 pages has been redacted to preserve the secrecy of grand jury proceedings per 5 U.S.C. § 552(b)(3), pursuant to Rule 6(e) of the Federal Rules of Criminal Procedure; to protect the personal privacy of living individuals per 5 U.S.C. § 552 (b)(6) and (b)(7)(C); to protect the identities of confidential sources per 5 U.S.C. § 552(b)(7)(D); and to protect confidential business information per 5 U.S.C. § 552 (b)(4). 

These documents, along with those previously released by NARA, were given to the Senate Judiciary Committee on August 9, 2018.

Monday, August 20, 2018 -- NARA has completed its review of an additional 12,349 pages of records of Brett Kavanaugh from his service with the Office of Independent Counsel Kenneth W. Starr.  Of these 12,349 pages, 9,809 pages are being released in full and 2,540 pages are being released in redacted form.  The information within these 2,540 pages has been redacted to preserve the secrecy of grand jury proceedings per 5 U.S.C. § 552(b)(3), pursuant to Rule 6(e) of the Federal Rules of Criminal Procedure; to protect the personal privacy of living individuals per 5 U.S.C. § 552 (b)(6) and (b)(7)(C); and to protect the identities of confidential sources per 5 U.S.C. § 552(b)(7)(D).  There are 224 pages of documents included in this release from boxes 1136, 2291, and 2293 of the Independent Counsel’s D.C. records that were previously reviewed between 2007 and 2010 in response to FOIA requests for records concerning the death of Vincent Foster.  Also included with this release, is a two page memorandum from Kavanaugh to the IC Staff located in D.C. box 1676 that was previously released from the papers of Sam Dash at the Library of Congress.

Monday, September 24, 2018 -- NARA has updated this page to include the entirety of publicly releasable records contained in boxes 2291, 2292, and 2293 that were previously reviewed between 2007 and 2010 in response to FOIA requests for Office of Independent Counsel Starr records concerning the death of Vincent Foster, as we determined that these boxes may contain additional records pertaining to Kavanaugh.
