FRC 01.2018 Written Concurrence for the Disposal of Records from The Agency with Legal Custody

Effective October 1, 2017

In accordance with 36 CFR 1233.20(b), the National Archives and Records Administration is required to obtain written concurrence for the disposal of records from the agency with legal custody.

Your Federal Records Center (FRC) will perform a preliminary review of transfer(s) included with this communication to determine their eligibility for disposal. The transfer(s) in question have met their disposition date based on their approved retention period and disposition authority. For your convenience, a copy of the SF 135, Records Transmittal and Receipt, for each transfer proposed for disposal is available to agencies deployed in ARCIS 2.0.

If your agency agrees with the destruction of the transfer(s), please email to the indicated Federal Records Center your concurrence, attaching the NA 13001(s), Notice of Eligibility for Disposal, or equivalent. Concurrences received after the initiation of the disposal cycle (January 1, April 1, July 1, and October 1) may be processed in the following disposal cycle. Transfers eligible for disposal for which the FRC receives no response will be returned to "Shelved" status after two years and continue to incur storage charges if held past their scheduled destruction date.

Please note, the FRC review process for disposal notices (NA 13001 or equivalent) was
revised beginning January 1, 2017. Only upon receipt of agency concurrence for the planned disposal will the FRC will make a complete hands-on, double-factor, review of the transfer documentation to re-confirm the transfer's eligibility for destruction. Due to the procedural change, some transfers will be moved to future disposal cycles after FRC review and/or agencies may identify a slightly higher percentage of transfers proposed for disposal that should be retained.

If your agency wants to defer to a later date the destruction of any transfers included with this communication due to some future action, event, or litigation, please indicate an upcoming date for review.
